Germany's NetzDG — The Global Template for Platform Speech Laws

Germany's Netzwerkdurchsetzungsgesetz (NetzDG) came into force requiring social media platforms with over 2 million users to remove "obviously illegal" content within 24 hours (and other illegal content within 7 days) or face fines of up to €50 million. Critics warned the impossible compliance timeline and severe fines would cause platforms to over-remove content rather than risk regulatory penalties — creating structural censorship through liability. NetzDG became the global template for platform speech regulation, directly influencing the EU's DSA and similar laws in Australia, India, Singapore, Brazil, and the UK. Legal scholars documented systematic over-removal of political speech in the years following its introduction.
