Meta Bans Trump — Oversight Board Upholds Suspension, Declines to Rule on Permanence

Following the January 6, 2021 Capitol events, Facebook and Instagram permanently banned President Donald Trump. Meta referred the case to its Oversight Board — the private quasi-judicial content moderation body. In May 2021 the Board upheld the suspension but ruled the permanent, indefinite nature was not consistent with Meta's own policies, requiring Meta to re-evaluate within six months. Meta subsequently reinstated Trump's accounts in February 2023, following a "guard rails" assessment. Critics on both sides noted the episode illustrated the lack of due process in platform bans affecting major political figures, and the Oversight Board's inability to constrain Meta's ultimate discretion.
